Terms of Service

These terms cover your use of Upscaly Studio for Windows and Upscaly for Android (together, "Upscaly" or "the apps"). By installing or using either app, you agree to them.
The apps are free
Upscaly is provided free of charge. There is no subscription, no per-image cost, no advertising, and no in-app purchase. Upscaly Studio's source is published on GitHub under the MIT License, and your rights to that source code are governed by that license.
What you can use it for
You may use Upscaly for personal or commercial work, including upscaling images you intend to publish or sell. We claim no rights over anything you process — your files are yours, before and after.
What you're responsible for
You are solely responsible for the content you process with Upscaly and for how you use the results. In particular, you agree that you will not use Upscaly to:
- Process content you do not have the right to use.
- Create or distribute material that is unlawful where you are.
- Produce imagery intended to deceive people about real individuals or events.
Because everything runs on your own device, we have no visibility into and no control over what you process — which also means enforcement of the above rests entirely with you.
AI models
Upscaly can download AI upscaling models published by third parties. Those models are distributed under their own licenses, by their own authors, and are not part of Upscaly itself. Your use of any model is subject to that model's license terms. We make no representation about the models' fitness, accuracy, or ownership.
No warranty
Upscaly is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Upscaling is a lossy, approximate process: results vary by source material, by model, and by hardware, and no particular quality of output is promised.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of Upscaly — including loss of data, loss of files, or damage to hardware. Upscaly never modifies your original files, but you remain responsible for maintaining your own backups.
Availability
Because the apps run locally, they will keep working whether or not this site or any download server stays online. We may stop publishing updates or new versions at any time, without notice; nothing already installed on your device stops functioning as a result.
Changes to these terms
These terms may be updated from time to time. The current version always lives on this page, with the "last updated" date above. Continuing to use Upscaly after a change means you accept the updated terms.
